Terms of service
Scope
These General Terms and Conditions apply, in their version valid at the time of contract conclusion, to all business relations between Soully GmbH (hereinafter: “we” or “us”) and our customers (hereinafter: “you”).
By ordering goods or services, these terms are deemed accepted. Deviating terms require written confirmation from us.
Contractual Nature
The presentation of products in the online shop does not constitute a legally binding offer, but is merely a non-binding online catalog. Simply adding products to the “shopping cart” does not constitute a binding order. A binding order is placed only when you click the “Order” button on the checkout page. We will then promptly send you a confirmation email; the contract is concluded upon receipt of this confirmation. Acceptance is subject to legal permissibility and the availability of the ordered goods or services.
Items temporarily out of stock must be reordered. Availability indicators in the online shop serve for informational purposes only and do not constitute a delivery guarantee; they may occasionally be inaccurate. Price fluctuations may occur due to harvest or currency variations. The price at the time of contract conclusion is decisive.
Delivery and Shipping Costs
We will deliver the goods you ordered to the address specified in your order as quickly as possible. In exceptional cases, products may be unavailable. In such cases, you will receive an email informing you of an exchange or refund. If you do not agree with the exchange, simply inform us by email (info@drinksoully.com) or by phone, and we will remove the product from your cart.
We are entitled to make partial deliveries or provide partial services at any time, provided this is reasonable for you. Any additional shipping costs for partial deliveries will be covered by us. If you are not at home, we are authorized to leave your delivery at your door or at another location as per your delivery instructions left during checkout. Only upon explicit customer request and excluding liability for potential damage due to misuse will we deliver inside your home (e.g., placing items on the kitchen table).
Minimum order value: CHF 20.40
All deliveries are charged at the indicated price plus applicable VAT. Shipping costs are not included.
Retention of Title; Withdrawal from Contract
We retain ownership of the goods until full payment is made. If you act in breach of contract, particularly if you fail to fulfill your payment obligation despite a reminder, we may withdraw from the contract after a reasonable grace period and demand the return of goods in your possession. After receiving the returned goods, we are entitled to dispose of them. We reserve the right not to enter into a contract following a negative credit check.
Payment Terms
We accept only the payment methods displayed during the ordering process. The purchase price and any shipping costs become due upon contract conclusion.
Invoices are payable within 20 days unless otherwise agreed. We may request advance payment without giving reasons; the order will be processed only after receipt of payment.
Vouchers are redeemable only under the conditions shown on the voucher. It is not permitted to sell vouchers or voucher codes without prior written consent from us. If payment is made using a voucher, any remaining balance will be credited to your account and applied automatically to your next order. Combining promotions, vouchers, or discount codes is not allowed.
Warranty and Liability
If goods are defective at the time of transfer of risk (e.g., manufacturer defect) or if an incorrect item is delivered, we will provide a replacement if possible. If replacement fails, you may demand cancellation of the purchase.
Our liability for our own fault, as well as that of our employees, legal representatives, and vicarious agents, is limited to intent.

Data Protection
We use the data you provide to fulfill and process your order. Data may be shared with the shipping company responsible for delivery, and payment data with our bank for processing. Your data will not be shared with third parties for advertising purposes. After full completion of the contract and full payment, your data will be blocked from further use and deleted after the statutory retention period.
We protect our website and systems with technical and organizational measures against unauthorized access, loss, or alteration of your data. Full protection against all risks is not possible.
Under the Swiss Data Protection Act (DSG), you have the right to free information about your stored data (Art. 8 DSG) and the right to correction (Art. 5 para. 2 DSG). Requests can be made electronically. Questions regarding your personal data and correction requests can be sent to: info@drinksoully.com.
You can visit our site without providing personal information. We store only access data without personal reference, such as your ISP, referring page, or requested file name. These data are used exclusively to improve our offerings. Personal data are collected only when voluntarily provided through orders, account registration, or newsletter sign-up.
Newsletter registration uses your email for our promotional purposes until you unsubscribe, which can be done at any time.
Cookies
We use cookies to make the website more attractive and functional. Most cookies are session cookies deleted after your browser session. Persistent cookies allow recognition on subsequent visits. Our partners may not use cookies to collect personal data. You can manage cookies through your browser settings, though some functions may not work without cookies.
Web Analytics

Credit Checks and Scoring
If we provide advance services (e.g., purchase on account), we may conduct a credit check using mathematically/statistically based procedures. Personal data required for this is sent to a credit agency, which provides probability scores for payment defaults. Your legal rights are respected during this process.
Facebook Social Plugins
Our site uses Facebook Social Plugins. Your browser connects directly to Facebook servers, sending data including your IP. If you are logged into Facebook, your visit may be linked to your profile. Customer Reviews
By submitting a review, you grant us an unrestricted license to use it. We reserve the right to edit, limit, or remove reviews. Reviews reflect only the opinion of the customer.
Right of Withdrawal
10.1 Consumers may withdraw from the contract within 48 hours of receiving goods. Withdrawal must be sent in writing via email to info@drinksoully.com.
10.2 Subscription cancellations must be made at least 5 calendar days before the next delivery. Individual orders cannot be canceled.
Final Provisions
Swiss Code of Obligations applies. Zürich is the exclusive place of jurisdiction for disputes arising from contracts with Soully GmbH. We reserve the right to amend these terms at any time; the current version is available at www.drinksoully.com.
